These Terms of Service (“Terms”) govern your use of NottaTalk mobile applications and the nottatalk.com website (the “Service”) operated by Automized Virtual Agent Services, LLC, doing business as NottaTalk (“NottaTalk,” “we,” “us”), based in Plano, Collin County, Texas, USA.
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
NottaTalk provides live two-way voice translation for conversations between two languages. Features, language coverage, and availability may change as we improve the product. Translation quality depends on audio conditions, accents, dialects, and the languages you choose; the Service may mis-hear or mis-translate, and you should not rely on it as the sole basis for medical, legal, safety, or other high-stakes decisions.
2. Eligibility
You must be at least 13 years old to use NottaTalk. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian where required by law. You must also meet any higher age required in your region.
3. Accounts and guests
You may try the Service as a guest subject to usage limits. Creating an account (when available) may be required for saving, syncing, purchases, or higher limits. You are responsible for activity under your account and for keeping sign-in credentials secure. We do not store your account password for the product.
4. Acceptable use
You agree not to:
- Use the Service unlawfully, or to harm, harass, or exploit others
- Attempt to reverse engineer, overload, probe, or disrupt the Service or its processors
- Bypass guest or plan limits, or share access in a way that defeats metering
- Upload malware or content you do not have the right to process
- Use the Service to process highly sensitive decisions without human review
We may suspend or terminate access for violations, abuse, or risk to the Service or other users.
5. Subscriptions and billing
Paid plans, if offered, are billed through the app store or other checkout we designate. Store refund rules apply to purchases made through Apple or Google. Plan details, prices, and renewals will be shown at purchase time. Until paid plans are publicly offered, guest and free access are provided at our discretion and may change.
6. Cancellation and deletion
You may stop using the Service at any time. If you have a paid subscription through an app store, cancel it in that store’s subscription settings. To request deletion of account data we hold, use the in-app controls when available or follow Delete account. After we process a verified deletion request, primary account data is removed; residual backups, if any, are cleared within 30 days where feasible. Some records may be retained longer when the law requires it (for example, completed transactions).
7. Intellectual property
NottaTalk, its logos, and the Service software are owned by Automized Virtual Agent Services, LLC or its licensors. These Terms do not transfer ownership. You keep rights in the content you speak or submit; you grant us a limited license to process that content solely to operate and improve the Service for you.
8. Privacy
Our Privacy Policy describes how we handle audio, transcripts, and account information. By using the Service, you acknowledge that audio must be sent to processors to deliver translation.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted operation or error-free translation.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOMIZED VIRTUAL AGENT SERVICES, LLC AND ITS OFFICERS, DIRECTORS, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50) IF YOU HAVE NOT PAID US. Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent allowed.
11. Indemnity
You will defend and indemnify us against claims arising from your misuse of the Service or violation of these Terms, to the extent permitted by law.
12. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Exclusive venue for disputes lies in the state or federal courts located in Collin County, Texas, unless applicable law requires otherwise. You and we consent to personal jurisdiction there.
13. Changes
We may update these Terms by posting a new version with a revised “Last updated” date. Continued use after the effective date constitutes acceptance, except where local law requires a different process.
